{"id":42439,"date":"2019-06-14T11:39:47","date_gmt":"2019-06-14T15:39:47","guid":{"rendered":"https:\/\/emu.edu\/now\/news\/?p=42439"},"modified":"2020-08-25T13:48:50","modified_gmt":"2020-08-25T17:48:50","slug":"fifty-four-brazilian-restorative-justice-advocates-attend-summer-peacebuilding-institute","status":"publish","type":"post","link":"https:\/\/emu.edu\/now\/news\/2019\/fifty-four-brazilian-restorative-justice-advocates-attend-summer-peacebuilding-institute\/","title":{"rendered":"Fifty-four Brazilian restorative justice advocates attend Summer Peacebuilding Institute"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">For human rights and constitutional law attorney <strong>Diego Dall \u2019Agnol Maia<\/strong>, attending Eastern Mennonite University\u2019s 2019 <\/span><a href=\"https:\/\/emu.edu\/spi\/\"><span style=\"font-weight: 400;\">Summer Peacebuilding Institute<\/span><\/a><span style=\"font-weight: 400;\"> (SPI) alongside more than 50 of his fellow Brazilian restorative justice (RJ) practitioners and advocates was transformative.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe don\u2019t need to be lawyers, prosecutors, judges or social workers here,\u201d he said. \u201cWe just need to be humans and talk about our experience, to change the world and make peace.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Maia helped organize the group of 54, the largest of any one nationality to attend SPI at one time. It included people who are judges, RJ promoters, officials of the judiciary, lawyers, university professors and municipal guards. Dozens more were on a waiting list.<\/span><\/p>\n<p><figure id=\"attachment_42441\" aria-describedby=\"caption-attachment-42441\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-42441 size-medium\" src=\"https:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2019\/06\/20190521-Brazillian-class-17-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2019\/06\/20190521-Brazillian-class-17-300x200.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2019\/06\/20190521-Brazillian-class-17-768x512.jpg 768w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2019\/06\/20190521-Brazillian-class-17-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-42441\" class=\"wp-caption-text\"><span style=\"font-weight: 400;\">The SPI experience has shaped the Brazilian conversation about RJ, and prompted the group to think about \u201cwhat we\u2019re doing in Brazil and what needs to be changed to do better, to expand this restorative understanding, and then to [bring] this powerful tool to the community for transformation,\u201d said Diego Dall \u2019Agnol Maia.\u00a0<\/span>(Photo by Jon Styer)<\/figcaption><\/figure><span style=\"font-weight: 400;\"> The Brazilian judicial system has shown growing interest in RJ, said SPI director <\/span><strong><a href=\"https:\/\/emu.edu\/faculty-staff\/?show=goldberw\">Bill Goldberg<\/a><\/strong><span style=\"font-weight: 400;\">, and for years EMU\u2019s <\/span><a href=\"https:\/\/emu.edu\/cjp\/\"><span style=\"font-weight: 400;\">Center for Justice and Peacebuilding<\/span><\/a><span style=\"font-weight: 400;\"> has been developing a relationship with people there. Director Emeritus of the <\/span><a href=\"http:\/\/www.zehr-institute.org\/\"><span style=\"font-weight: 400;\">Zehr Institute<\/span><\/a><span style=\"font-weight: 400;\"> and \u201cgrandfather of restorative justice\u201d <\/span><strong><a href=\"https:\/\/emu.edu\/faculty-staff\/?show=zehrh\">Howard Zehr<\/a><\/strong><span style=\"font-weight: 400;\"> and circle processes trainer <strong>Kay Pranis<\/strong> have each traveled there to provide training. Brazilians have also come to EMU for SPI in previous years, and <\/span><a href=\"https:\/\/emu.edu\/now\/news\/2017\/zehr-institute-facilitates-five-day-workshop-brazilian-judges-prosecutors-restorative-justice-practitioners\/\"><span style=\"font-weight: 400;\">25 came to campus<\/span><\/a><span style=\"font-weight: 400;\"> in 2017 for a weeklong series of RJ lectures and training. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Most participants this year took courses on <\/span><a href=\"https:\/\/emu.edu\/cjp\/star\/\"><span style=\"font-weight: 400;\">Strategies for Trauma Awareness and Resilience<\/span><\/a><span style=\"font-weight: 400;\"> (STAR) I and victim-offender conferencing. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The SPI courses, Maia said, provided tools that will broaden how RJ is used in Brazil, where current guidelines proposed by the national council of judges focus on the use of circle processes. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHere at EMU, we are learning that RJ is not what the law says, but what the community and people feel about the justice,\u201d he said. \u201cIt has given me a new lens, and prepared me and other people in the group to talk more about restorative justice, and be ready in our spirits to go back to Brazil and talk about how these theories and practices are important to the community and not only to judges, prosecutors and lawyers.\u201d<\/span><\/p>\n<h3><b>Trauma-informed justice<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">RJ, which is grounded in repairing the harm of crime in processes that engage individuals and other community members, is well served by trauma training, said second-time SPI participant <strong>Mayara Carvalho<\/strong>. She has practiced RJ in the Brazil juvenile justice system, schools and university settings, and she earned her PhD researching restorative practices in communities. (Photo by Macson McGuigan)<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">In addition to her book <\/span><i><span style=\"font-weight: 400;\">Justi\u00e7a Restaurativa na Comunidade<\/span><\/i><span style=\"font-weight: 400;\">, about using RJ in communities, Carvalho has written a guide titled \u201cPrograma N\u00d3S &#8211; Belo Horizonte\u201d for using restorative practices in schools. Brazilian schools, she said, are often \u201ca kind of door to criminalization\u201d because of how they respond to students with problematic behavior.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe\u2019re trying to develop nonviolent communication, restorative practices and circle processes inside schools,\u201d she said, \u201cto work on conflicts in a better way.\u201d<\/span><\/p>\n<h3><b>Changing the conversation<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The SPI experience has shaped the Brazilian conversation about RJ, said Maia, and prompted the group to think about \u201cwhat we\u2019re doing in Brazil and what needs to be changed to do better, to expand this restorative understanding, and then to [bring] this powerful tool to the community for transformation.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It\u2019s not only about law, he said: It\u2019s also about a social theory of justice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn Brazil we just see what the law says, and apply this in cases,\u201d he said. \u201cNow, we are starting to think, \u2018Is this justice, to resolve the case only by law?
