{"id":26638,"date":"2016-01-20T15:22:22","date_gmt":"2016-01-20T20:22:22","guid":{"rendered":"http:\/\/emu.edu\/now\/news\/?p=26638"},"modified":"2016-06-27T16:00:12","modified_gmt":"2016-06-27T20:00:12","slug":"in-slate-series-on-victims-rights-howard-zehr-identifies-entrenched-challenges-to-systematic-change-through-restorative-justice","status":"publish","type":"post","link":"https:\/\/emu.edu\/now\/news\/2016\/in-slate-series-on-victims-rights-howard-zehr-identifies-entrenched-challenges-to-systematic-change-through-restorative-justice\/","title":{"rendered":"In Slate series on victim&#8217;s rights, Howard Zehr identifies &#8216;entrenched&#8217; challenges to systematic change through restorative justice"},"content":{"rendered":"<p>When freelance legal affairs journalist Mark Obbie wrote a <a href=\"http:\/\/markobbie.com\/wordpress1\/recent-work\/crime-victim-stories\/\">six-part series on crime victims<\/a> for <em>Slate<\/em> in 2015, he made sure to include Howard Zehr, professor of restorative justice at Eastern Mennonite University\u2019s <a href=\"http:\/\/www.emu.edu\/cjp\">Center for Justice and Peacebuilding<\/a> and co-director of the <a href=\"http:\/\/zehr-institute.org\/\">Zehr Institute for Restorative Justice<\/a>.<\/p>\n<p>Obbie\u2019s sixth installation, appearing last month and titled \u201c<a href=\"http:\/\/www.slate.com\/articles\/news_and_politics\/crime\/2015\/12\/restorative_justice_its_rise_and_fall_in_rural_upstate_new_york_county.html\">They Knew It Was the Right Thing to Do<\/a>,\u201d examined the \u201cunlikely rise of restorative justice\u201d in western New York\u2019s Genesee County in the 1980s. <a href=\"https:\/\/www.emu.edu\/personnel\/people\/show\/zehrh\">Zehr<\/a>, identified as the \u201cleading thinker\u201d of the restorative justice movement, spoke about the movement\u2019s beginnings.<\/p>\n<figure id=\"attachment_26644\" aria-describedby=\"caption-attachment-26644\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/emu.edu\/now\/news\/2016\/01\/in-slate-series-on-victims-rights-howard-zehr-identifies-entrenched-challenges-to-systematic-change-through-restorative-justice\/screenshot-newsblog\/\" rel=\"attachment wp-att-26644\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-26644 size-medium\" src=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2016\/01\/screenshot-newsblog-300x182.jpg\" alt=\"screenshot-newsblog\" width=\"300\" height=\"182\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2016\/01\/screenshot-newsblog-300x182.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2016\/01\/screenshot-newsblog.jpg 610w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-26644\" class=\"wp-caption-text\">Freelance legal affairs writer Mark Obbie researched and wrote a series on victims rights, with funding from the Soros Media Justice Fellowship. In the sixth and final article, Zehr, widely referred to as the &#8220;grandfather of restorative justice,&#8221; is tapped for his opinion about the state of the movement.<\/figcaption><\/figure>\n<p>\u201cOne of the reasons the whole restorative justice field started,\u201d Zehr says, \u201cis we felt like victims are not just being neglected, they were being re-traumatized by this process. And we were trying to figure out how can we engage them more, give them more options, more information, meet their needs in a better way.\u201d<\/p>\n<p>The article tracks the work of Dennis Wittman and Doug Call as they worked against all odds to introduce an alternative to the \u201cbail \u2018em and jail \u2018em\u201d system of the courts that resulted in overcrowded prisons. Call was elected sheriff of the county, located midway between Buffalo and Rochester, on this platform and hired the visionary Wittman. They formed a program called <a href=\"http:\/\/www.co.genesee.ny.us\/departments\/geneseejustice\/index.html\">Genesee Justice<\/a>, then set about securing funding and winning over supporters in the justice system, government, community and beyond.<\/p>\n<p>Call remained in the project for seven years, but Wittman continued for a quarter-century, throwing himself fully into the effort while introducing a variety of innovative and successful approaches with pretrial diversions, victim-offender dialogue, community meetings, and more. Genesee Justice eventually ran into challenges as funding dried up and some of the original vision faded, especially after Wittman\u2019s retirement in 2005. The program continues today, but in a reduced form.<\/p>\n<p>Zehr says in the article that, despite many positive attributes, the restorative justice movement has struggled for recognition and implementation on a large scale due to a \u201cfirmly entrenched punitive culture\u201d and the lack of a central organization.<\/p>\n<p>He also notes that such movements are often eventually \u201cco-opted\u201d by government agencies and others, resulting in diluted or distorted forms of restorative justice. Charismatic and well connected individuals like Wittman are often the impetus for initial change, Zehr says, and continuing their work after a leadership change can often be a challenge. (\u201cA clear grounding in principles and values can help avoid this tendency,\u201d Zehr commented after reading the piece.)<\/p>\n<p>Nonetheless, Obbie thought restorative justice is an important area to examine during his investigation, which was funded by a Soros Justice Media Fellowship. In an overview of the series, the author writes: \u201cWe owe it to victims to understand them and their experience much more deeply than we do when we shed a tear, rage at the \u2018senseless\u2019 crime that befell them, and then move in, secure in the belief that excessive punishment is the primary response needed. And we must offer victims more options than just indulging their first reactions.\u201d<\/p>\n<p>The Zehr Institute is in the midst of a three-year project, funded by Porticus, to assess the field and map its future. A <a href=\"http:\/\/emu.edu\/now\/news\/2015\/07\/restorative-justice-experts-join-in-zehr-institutes-3-year-project-to-map-the-future-of-the-field\/\">May 2015 consultation<\/a> attended by 36 global leaders was the first step.
