During a three-day visit to Harrisonburg, the judges and officials of Nepal\u2019s <a href=\"http:\/\/njanepal.org.np\/\">National Judicial Academy<\/a> (NJA) in Kathmandu engaged with community practitioners from K-12 schools and in higher education, observed courts in session, visited a re-entry program, and met with personnel working within the criminal justice system.<\/p>\n<p>\u201cOur goal for this learning tour was to expose the delegation to many different applications of restorative justice in the local area beyond the criminal justice system,\u201d said professor <a href=\"https:\/\/www.emu.edu\/personnel\/people\/show\/cds494\">Carl Stauffer<\/a>, who hosted the delegation as co-director of the <a href=\"http:\/\/zehr-institute.org\/\">Zehr Institute for Restorative Justice<\/a>. \u201cMany in the delegation later said they were truly impressed with the potential for restorative justice to impact the whole of society.\u201d<\/p>\n<p>The delegation\u2019s visit was sponsored by <a href=\"http:\/\/asiafoundation.org\/\">The Asia Foundation<\/a> with support from the United States Agency of International Development. The foundation is engaged in a long-term project to introduce and integrate restorative justice practices into the Nepali criminal justice system through training of judges, prosecutors, lawyers and law enforcement officials, said program officer Ramkanta Tiwari, who escorted the group.<\/p>\n<p>The foundation also wants to establish the academy as a resource center for restorative justice in Nepal and in the larger South Asia region, Tiwari added.<\/p>\n<h3><strong>Well-placed to effect change<\/strong><\/h3>\n<figure id=\"attachment_25893\" aria-describedby=\"caption-attachment-25893\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/judgesbook.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25893 size-medium\" src=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/judgesbook-300x200.jpg\" alt=\"judgesbook\" width=\"300\" height=\"200\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/judgesbook-300x200.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/judgesbook.jpg 563w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-25893\" class=\"wp-caption-text\">The delegation, comprised of judges and representatives of Nepal&#8217;s National Judicial Academy, plan to develop restorative justice curriculum for the training of judges, judicial officials and law enforcement personnel.<\/figcaption><\/figure>\n<p>Officials from the academy included Keshari Raj Pandit, NJA&#8217;s executive director; Bimal Poudel, registrar; and Rajan Kumar, program manager, as well as The Honorable Rajendra Kharel, judge of District Court of Lalitpur and The Honorable Devendra Gopal Shrestha, justice of the Supreme Court of Nepal.<\/p>\n<p>On the first full day at EMU, the group attended a seminar with Stauffer, and were joined for a discussion by <a href=\"https:\/\/www.emu.edu\/personnel\/people\/show\/zehrh\">Howard Zehr<\/a>, who is co-director with Stauffer of the Zehr Institute of Restorative Justice. Zehr, who had visited Nepal years ago to speak about restorative justice, remarked that at that time, there was \u201clittle knowledge and only marginal interest.\u201d<\/p>\n<p>He found the delegation\u2019s interest to be &#8220;inspiring,&#8221; he said. \u201cThey are strategically placed to encourage the implementation of restorative justice not only in Nepal but in the entire region \u2026\u00a0It is exciting to see this level of interest and commitment now.\u201d<\/p>\n<h3><strong>Truth and reconciliation discussed<\/strong><\/h3>\n<figure id=\"attachment_25894\" aria-describedby=\"caption-attachment-25894\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/MG_9681_facebook.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25894 size-medium\" src=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/MG_9681_facebook-300x200.jpg\" alt=\"keshari raj pandit\" width=\"300\" height=\"200\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/MG_9681_facebook-300x200.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/MG_9681_facebook-1024x682.jpg 1024w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/MG_9681_facebook.jpg 1400w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-25894\" class=\"wp-caption-text\">Keshari Raj Pandit, NJA executive director, talks with Jordan Detwiler-Michaelson, graduate assistant with the Zehr Institute for Restorative Justice, while Ramkanta Tiwari, program director of The Asia Foundation, looks on.<\/figcaption><\/figure>\n<p>Stauffer was one of the reasons the delegation visited EMU; he had visited Nepal in 2014 with San Francisco-based expert <a href=\"http:\/\/sujathabaliga.com\/\">Sujatha Baliga<\/a> to present and participate at an Asian Foundation-hosted roundtable with judicial representatives from Nepal, India, Sri Lanka and Bangladesh: this reciprocal visit was his chance to share in the hospitality and learning.<\/p>\n<p>One aspect of Stauffer\u2019s past professional experience \u2013 his 16 years working with transitional justice in Africa, including the South African Truth and Reconciliation Commission \u2013 was of particular interest to the delegation.<\/p>\n<p>After a decade of conflict between pro-democracy and Maoist supporters, Nepal has begun a peace process that included a transitional justice bill to bring accountability for historic harms. The government also established a Truth and Reconciliation Commission and Commission on Inquiry into Disappearances, which seeks to utilize restorative justice practices on behalf of victims and affected community members.<\/p>\n<p>During an introductory circle process with Stauffer, several of the men related how learning about restorative justice had enriched and enlivened their professional engagement. Their goals, they related to Stauffer, were to learn more about how the principles could relate to their specific interests, such as juvenile justice, but also to the criminal justice system as a whole.<\/p>\n<p>\u201cThere is not much room for dialogue in our system,\u201d said Poudel. \u201cWe would like to know more about how to include that.\u201d<\/p>\n<h3><strong>\u2018RJ\u2019 has broad applications<\/strong><\/h3>\n<figure id=\"attachment_25895\" aria-describedby=\"caption-attachment-25895\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/judges-richi.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25895 size-medium\" src=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/11\/judges-richi-300x184.jpg\" alt=\"judges richi\" width=\"300\" height=\"184\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/judges-richi-300x184.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/11\/judges-richi.jpg 610w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-25895\" class=\"wp-caption-text\">Richi Yowell, program director at Gemeinschaft Home, passes out information to the Nepali delegation about the transitional home for formerly incarcerated men in Harrisonburg.<\/figcaption><\/figure>\n<p>On the final day, the delegation met with various collaborators of Harrisonburg\u2019s <a href=\"https:\/\/emu.edu\/now\/news\/2015\/03\/harrisonburg-police-and-community-members-join-hands-in-offering-restorative-justice-option\/\">community restorative justice initiative<\/a> at their various worksites. These practitioners included <a href=\"http:\/\/emu.edu\/now\/news\/2015\/05\/in-support-of-harrisonburgs-new-restorative-justice-initiative-city-police-lieutenant-joins-peacebuilding-institute-training\/\">Lieutenant Kurt Boshart<\/a>, of the Harrisonburg Police Department; Sue Praill, director of restorative justice at the <a href=\"http:\/\/www.fairfieldcenter.org\/\">Fairfield Center<\/a>; and <a href=\"https:\/\/emu.edu\/now\/peacebuilder\/2011\/08\/the-restoration-of-james-madison-university\/\">Josh Bacon<\/a>, associate dean of students\/student accountability and restorative practices at James Madison University.<\/p>\n<p>A last tour stop was the <a href=\"http:\/\/www.gemeinschafthome.org\/\">Gemeinschaft Home<\/a>, where program director Richi Yowell talked about how the therapeutic transitional home for formerly incarcerated men assists in easing the re-integration process back into society.<\/p>\n<p>The delegation was especially interested to learn more about how government agencies collaborate with non-state entities, Tiwari said.
