Najla Mangoush argues it can in a <a href=\"http:\/\/www.usip.org\/publications\/2015\/05\/28\/customary-practice-and-restorative-justice-in-libya-hybrid-approach\">June 2015 special report titled \u201cCustomary Practice and Restorative Justice in Libya: A Hybrid Approach\u201d<\/a>\u00a0 published by the <a href=\"http:\/\/www.usip.org\/about-usip-0\">United States Institute of Peace <\/a>(USIP). But she doesn\u2019t claim it will be easy.<\/p>\n<p>\u201cRestorative justice is a new concept for Libya,\u201d said Mangoush, who graduated in May with a <a href=\"http:\/\/www.emu.edu\/cjp\/grad\/\">master\u2019s in conflict transformation<\/a> from Eastern Mennonite University\u2019s<a href=\"http:\/\/www.emu.edu\/cjp\/\"> Center for Justice and Peacebuilding<\/a> (CJP) and will begin doctoral studies at George Mason University.<\/p>\n<p>In her native Libya, punitive law is much more common. But following the overthrow of long-standing Libyan dictator Muammar Gadhafi, rule of law has virtually disintegrated and reconciliation efforts have been short-lived and unsuccessful.<\/p>\n<p>Mangoush says restorative justice can provide a foundation for peace. \u201cIn integrating restorative principles with customary practices \u2014 thereby transforming the relationships that sustain violence <span class=\"st\">\u2014 <\/span>Libya would create the opportunity to move toward peace and stability,\u201d she writes.<\/p>\n<h3>Restorative justice helpful in other war-torn countries<\/h3>\n<figure id=\"attachment_25090\" aria-describedby=\"caption-attachment-25090\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25090 size-medium\" src=\"http:\/\/emu.edu\/now\/is\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease-300x182.jpg\" alt=\"Najlacommencement_newsrelease\" width=\"300\" height=\"182\" srcset=\"https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease-300x182.jpg 300w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease-1024x621.jpg 1024w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease-610x370.jpg 610w, https:\/\/emu.edu\/now\/news\/wp-content\/uploads\/sites\/43\/2015\/08\/Najlacommencement_newsrelease.jpg 2000w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-25090\" class=\"wp-caption-text\">Najla Mangoush was honored as the Center for Justice and Peacebuilding&#8217;s commencement speaker during Eastern Mennonite University&#8217;s May 2015 graduation ceremony. (Photo by Michael Sheeler)<\/figcaption><\/figure>\n<p>Mangoush, who came to Harrisonburg with her two daughters as a Fulbright scholar two years ago, is a USIP country representative in Libya. Before the revolution in 2011, she worked in Libya as a criminal lawyer and enjoyed opportunities not available to many women in Muslim societies.<\/p>\n<p>But opportunity didn\u2019t translate to freedom, she said. Under Gadhafi, militants perpetrated rampant human right violations and violently suppressed political dissidents. She supported the movement to remove him from power. What she didn\u2019t anticipate was that without a strong government to step in, extremists would rush to fill the power void.<\/p>\n<p>Now two warring factions fight for control\u00a0\u2014 both sides have inflicted substantial harm on each other and the Libyan people. \u201cLegalistic and punitive processes will not be enough for Libya to make the transition from war to peace and to address its legacy of violence,\u201d she says. \u201cTo do so, the country must also turn to restorative justice and its focus on the needs of victims, offenders, and the community.\u201d<\/p>\n<p>Mangoush\u2019s idea of using restorative justice combined with Libyan customary law is innovative, but not unheard of. A similar plan was used with some success in Somaliland, she said.<\/p>\n<p>In both countries, customary law works like this: traditional leaders who are considered neutral to a conflict are called in to mediate a disagreement. The leaders listen to both sides, gain trust and then suggest a solution. Customary law in Libya, called <em>Solha,<\/em> is a local concept, which the leaders use to refer to the customary law. The word<em> Solha <\/em>means \u201crestoration\u201d in the English language; it is an embedded mechanism within the Libyan society to resolve conflict in Libya by which the traditional leaders act as mediators between the victims and the offenders to handle the wrongdoing. One of the significant strengths within the <em>Solha<\/em> process is the idea of building social capital that promotes alliances and trust between tribes and leaders.<\/p>\n<p>In her report, Mangoush suggests that training native leaders in restorative techniques could provide traditional leaders with the skills they need to provide societal-wide trauma healing.<\/p>\n<h3>Second report features interviews with Libyan leaders<\/h3>\n<p>Restorative justice is a concept Mangoush encountered at EMU, a place where she also learned \u201chow to respect cultural context.\u201d The report <span class=\"st\">\u2014<\/span> written at the suggestion of her mentor and CJP professor <a href=\"https:\/\/www.emu.edu\/personnel\/people\/show\/cwb784\">Catherine Barnes<\/a> <span class=\"st\">\u2014<\/span> helped her to \u201ctest the ideas I learned [at EMU], and inspired by the father of restorative justice <a href=\"https:\/\/www.emu.edu\/personnel\/people\/show\/zehrh\">Howard Zehr <\/a>creatively find a way to implement them in Libya.\u201d<\/p>\n<p>USIP special reports such as Mangoush\u2019s offer research and practical problem-solving approaches to a wide variety of issues: recent reports covered Afghan President Ashraf Ghani\u2019s outreach to Pakistan; the effects of energy shortages in Pakistan; land conflict in Afghanistan; and lessons learned from failed relations between Hamid Karzai and the United States.<\/p>\n<p>A second USIP publication by Mangoush will include interviews with approximately 10 Libyan leaders about the potential of her proposed strategy to heal conflict.<\/p>\n<p>\u201cIf Libya is to overcome its legacy of violence and division, and heal the traumas of its recent past, it needs to restore (or in some cases nurture) relationships between individuals, groups, and communities,\u201d she concluded. \u201cCertainly, obstacles to [restorative justice\u2019s] use in Libya are significant,\u201d but the opportunity to combine restorative justice and customary law may be the key to repairing the health of Libyan society.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Can restorative justice work in countries where justice is elusive and rule of law suspect?
